The ordinance title says the action adopted and added Escondido Municipal Code Chapter 16, Article 9, Sections 16-410 through 16-425; repealed Section 18-101; amended Sections 18-103, 23-4, and 23-5; and regulated sidewalk vending.

Stated Findings

The ordinance says the California Legislature passed the Safe Sidewalk Vending Act in 2018, effective January 1, 2019. It also says certain Escondido Municipal Code sections restricted sidewalk vendors' ability to do business in the City and may have conflicted with state law.

The ordinance states that the City Council sought to comply with state law and recognized that sidewalk vending provides entrepreneurship and economic opportunities to low-income and immigrant communities, contributes to vibrant public space, and increases access to culturally significant goods and merchandise.

The ordinance also states that the City Council sought to protect health, safety, welfare, public-space use, natural resources, and recreational opportunities. It lists City interests in food and merchandise sales in public rights-of-way, trash and debris removal, food-safety and health regulations, and pedestrian, vehicle, and public-facility access.

Code Actions

Ordinance No. 2026-04R says the Escondido Municipal Code was amended to add Chapter 16, Article 9, titled Sidewalk Vending, as Exhibit A.

It also says Section 18-101 was repealed; Section 18-103 was amended to state that sidewalk vending is subject to the Safe Sidewalk Vending Ordinance; Section 23-4 was amended to add a related exception; and Section 23-5 was amended to add a related exception.
